Berkeley County man receives thousands of dollars in payments after being arrested on ‘Live PD’

BERKELEY COUNTY, SC (WCSC) – A Berkeley County man has received a $40,000 payout from the State Insurance Reserve Fund after filing a lawsuit in connection with his arrest that occurred on a television show.

The lawsuit claims Kirk Gaskins was arrested at his home during a broadcast of the show formerly known as “Live PD” in March 2020 and the host said police were serving a “domestic violence warrant.” However, documents show the problem was that there was no warrant for domestic violence or any other violent crime.

In the lawsuit, Gaskins claims Berkeley County deputies arrested him at his home but never told him why. The next day, the lawsuit claims Gaskins showed up for a bond hearing, but the judge did not grant him bond because there were no charges and ordered him released.

However, the lawsuit claims Gaskins was not released because the Berkeley County Detention Center found a warrant from Charleston County for nonpayment of child support. The lawsuit says the only warrant was from 2019 for taking money and then not doing promised work, but he was never told about the warrant.

The lawsuit says Gaskins never committed any crimes involving violence and that the fact that police surrounded his home with guns in hand was only intended to portray him as a dangerous criminal.

Gaskins received a $40,000 payment from the state’s Insurance Reserve Fund.

Berkeley County and the sheriff’s office declined to provide any comment at this time.
